OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS MARMON FOODSERVICE TECHNOLOGIES TRADE PROMOTION (“PROMOTION”). A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. Subject to federal, state, and local laws, regulations, and ordinances. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military Installations located in foreign countries, and where prohibited by law.
SPONSOR: The Sponsor of the Promotion is Marmon Foodservice Technologies, Inc. (“Marmon” or “Sponsor”), 355 Kehoe Boulevard, Carol Stream, IL 60188.
Entry Period: Participants may enter the Promotion February 26 – 28, 2025 during public event hours (“Entry Period”) of the North American Association of Food Equipment Manufacturers(NAFEM) Trade Show (the “Event”) taking place in Atlanta, Georgia. Sponsor’s clock will be the official timekeeping device of the Promotion and all of Sponsor’s determinations involving Promotion timing shall be final.
ELIGIBILITY: The Promotion is a trade promotion that is not open to the general public. The Promotion is open to event attendees who are (A) legal U.S. residents currently residing in the 50 United States including the District of Columbia; (B) age 18 or older and the age of majority in their state of residence as of the date of entry. All entries must (C) identify a business to receive the prize which (i) is in the food and beverage industry, (ii) operates over 500 stores in the U.S.; (iii) employs over 1,000 employees; and (iv) has over $500 million in annual revenue. Employees, officers, and directors of Sponsor or Sponsor’s parents, affiliates, subsidiaries, representatives, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win. Employees, officers and directors of competitors of Sponsor or Sponsor’s affiliates are not eligible to enter or win. Participation constitutes entrant’s full and unconditional agreement to these Official Rules, which are final and binding in all matters related to the Promotion. Sponsor reserves the right to verify the eligibility of winners.
HOW TO ENTER:
During the Entry Period, scan the QR code at Sponsor’s booth #5840 at the Event and provide all required information in a website contact form to enter the Promotion (each, an “Entry”). Limit one (1) Entry per person during the Entry Period. Additional entries will be disqualified.
In order for an Entry to be valid, the Entry must be completed in full, and all information provided must be truthful. Marmon is not responsible for lost, misdirected, false, corrupted, illegible, or late entries. Marmon shall have the sole discretion to determine the validity of an Entry. All potential winners are subject to verification before any prize will be awarded. Automated or bulk entries or entries submitted by third parties will be disqualified. Incomplete, illegible, corrupted, or untimely entries are void and will be disqualified. By entering the Promotion, Entrant agrees that they have permission to enter into the Promotion on behalf of the identified business.
PRIZE: Promptly following the end of the Entry Period, Sponsor will randomly select one (1) potential winner from all eligible entries to receive the following prize: one (1) Grand Prize of $25,000 Kitchen Innovation Credit for future purchases of Sponsor’s products or solutions. The odds of winning depend on the total number of eligible entries received. Total Prize ARV: $25,000. The Prize will be awarded to the business identified in the winning entry (“Winner”).
The Prize must be redeemed within twelve (12) months from the prize notification date, can only be used for future purchases of Sponsor’s products and cannot be applied retroactively to existing purchases or contracts. Prize usage is restricted to newly developed products or solutions offered by Sponsor and/or products that Sponsor and Winner jointly develop. As part of accepting the Prize, winner agrees to meet with Sponsor and may be required to execute a separate agreement with Sponsor specifying the terms of the Prize award and usage, including collaboration expectations.
The potential winner is subject to verification before the Prize will be awarded. The potential winner agrees to furnish any documentation requested by Sponsor in connection with the awarding of the Prize, including travel documents, releases, and affidavits or declarations of eligibility and liability/publicity releases. If a selected Winner cannot be contacted within seven (7) days of the drawing, is ineligible, fails to complete and return any required affidavit of eligibility within five (5) days of being contacted, the prize may be forfeited and awarded to an alternate entrant who will be randomly selected from the remaining eligible entries. The business that was identified in the winning entry must agree to receive the Prize and sign/return any declarations of eligibility and liability/publicity releases requested by Sponsor. If the identified business does not agree to receive the Prize or fails to return any required affidavit of eligibility within five (5) days of being contacted, the prize may be forfeited and awarded to an alternate entrant who will be randomly selected from the remaining eligible entries. All prizes will be awarded. The Prize is non-transferable, and no substitutions are allowed except by Sponsor who may award a prize for one of comparable or greater value for any reason. Winner is solely responsible for all taxes on the prize, including applicable income or local personal property taxes on the prize. Winner will, if applicable, be issued a 1099 form from the Internal Revenue Service. By entering this Promotion, each participant accepts and agrees to be bound by these Official Rules and the decisions of the Sponsor. By participating in this Promotion, each participant also represents that there is no legal or contractual restriction barring participation, including, without limitation, any restriction from participant’s employer or company.
GENERAL CONDITIONS. This Promotion is governed by the laws of the United States and the state of Illinois. IF, FOR ANY REASON, THE PROMOTION IS NOT CAPABLE OF RUNNING AS PLANNED, SPONSOR RESERVES THE RIGHT AT ITS SOLE DISCRETION TO CANCEL, TERMINATE, MODIFY OR SUSPEND THE PROMOTION AT ANY TIME WITHOUT NOTICE OR OBLIGATION. SPONSOR SHALL NOT BE RESPONSIBLE FOR ANY INCORRECT OR INACCURATE INFORMATION, INCLUDING, WITHOUT LIMITATION, ANY TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE PROCESSING OF SUBMISSIONS IN THE PROMOTION. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process or the legitimate operation of the Promotion or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. By participating in the Promotion, all participants agree that the state and federal courts located in the state of Illinois shall have exclusive jurisdiction over claims arising out of the Promotion and matters related thereto, and that all participants agree to the venue and jurisdiction of such Illinois courts.
RELEASES AND LIMITATIONS OF LIABILITY: By participating in the Promotion, except where prohibited by law, participant agrees to release and hold harmless Sponsor, its parents, affiliates, subsidiaries, retailers, distributors, advertising and promotion agencies, suppliers, and those acting pursuant to Sponsor’s authority, and all of their officers, directors, employees, agents, and legal counsel (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any compensation, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) errors on Sponsor’s website; (c) lost, delayed, postage-due, misdirected, or undeliverable communications; (d) errors in the administration of the Promotion or the processing of entries; or (e) any injuries, losses, or damages of any kind to participants or any other person or entity, including personal injury or death to participantor any other person or damage to personal or real property, due in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the compensation, entry, or participation in this promotion or in any promotion-related activity, or any claims based on publicity rights, defamation, or invasion of privacy or merchandise delivery.
Except where prohibited by law, participants agree that the Released Parties and those acting pursuant to their authority shall have the perpetual worldwide right and permission, in any media now known or hereinafter developed, to print, publish, broadcast, use, edit, modify and create derivative works the participant’s name (both individual name and employer/company name), portrait, picture, voice, likeness, biographical information, Entry and any portion of the information or material contained therein, for advertising, trade, and promotional purposes (including the announcement of winner’s name on television or radio broadcast) without further consideration, compensation, permission, or notification.
Participant further agrees that, except where prohibited by law, in any cause of action Sponsor’s liability will be limited to the cost of entering and participating in the Promotion, if any, and in no event shall the Sponsor be liable for attorney’s fees. Without limiting the foregoing, everything regarding this Promotion, including the web site and any compensation, is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
PRIVACY: Information collected from participants is subject to Sponsor’s Privacy Policy, which can be found at https://www.marmon.com/privacy-policy/. Sponsor and Sponsor’s agents, affiliates, subsidiaries, representatives or service providers may use participants’ and/or referrals’ personal information submitted with entry for purposes of prize fulfillment and/or for future marketing by Sponsor, such as to notify them of a product or promotion that Sponsor thinks may be of interest.
